He Wants to Complete Obama’s Leftist Coup D’état by Quickly Packing the Courts with Radicals Before Reid and Obama Lose Power in the 2014 Elections
He exercised what has become known as “The Nuclear Option.”
The Senate filibuster first came into being in 1837.
The idea at the core of America’s federal governing structure is that the U.S. House of Representatives is driven more by popular will — often passions of the moment. But the Senate is supposed to be the world’s greatest deliberative body. It’s the chamber where legislation and other federal action slows down for more sober consideration.
The Senate is not supposed to be another U.S. House of Representatives.
This is a principle that has served America well for two centuries by preventing much bad legislation and by forcing Presidents to appoint judges and high government officials who have support from both political parties.
Harry Reid, with Barack Obama’s support, undid all of that with 52 votes in the Senate.
Obama and Reid don’t care about American tradition or rules. They just do what they want to do.
What Reid and Obama have shown us is that there are no longer any rules. The rules now are whatever those in power say they are.
Raw political power is all that matters in America now.
That’s a slippery slope to tyranny.
I actually think Reid’s decision to eliminate the filibuster will end up being disastrous for Obama and ObamaCare in the end.
It means that if Republicans retake the Senate and the Presidency between now and 2017 (which I believe is likely) we’ll be able to repeal ObamaCare by a one-vote majority in the Senate. We won’t need a 60-vote super-majority.
Yes, I know Reid only eliminated the filibuster for Presidential appointments.
But now he’s set the precedent. The filibuster is now over forever – for better or worse.
So if you are in the minority party in the Senate, there’s no reason to show up for work anymore.
Democrats are very likely to find themselves in the minority in the Senate after the 2014 mid-term elections.
The question is: Why would Harry Reid and Barack Obama do this?
They can read polls. They can see what’s likely to happen in the 2014 and 2016 elections.
My prediction is Democrats will soon rue the day when they abolished the filibuster.
I believe the reason they did this is precisely because Obama and Reid can see the handwriting on the wall. They know they are staring in the face of disastrous election results for Democrats in 2014 and 2016 when they will lose control of the Senate and the Presidency.
So what they want to do is quickly pack the federal courts (most immediately the Circuit Court of Appeals in Washington, DC) with as many radical left judges as possible. With the filibuster now gone, Obama can appoint three radical left judges to the DC Circuit of Appeals Court right away.
The DC Circuit Court of Appeals is the most powerful court in the land under the Supreme Court.
It’s this Court that rules on whether what the federal government is doing is Constitutional. Some cases ruled on by this Court end up before the Supreme Court. But most cases don’t. So this court has the final say on the overwhelming majority of cases it hears. So this is a very important court.
Obama and Reid want to make their leftist revolution in America permanent by packing this court, and all federal courts, with radical judges who will legislate from the bench and override much of what a Republican Congress and President want to do. The kinds of judges Obama will appoint don’t care about the Constitution, don’t like the Constitution, don’t even care about the rule of law.
Like Obama and Reid, these judges will just do whatever they want to do. They will try to render the coming Republican Congress and President irrelevant.
Obama might even get another Supreme Court appointment.
If Obama is able to replace just one of the five center-right Justices with a Saul Alinsky-style radical, the Left will have a majority on the Supreme Court. The Court will then simply declare whatever a Republican Congress or President try to do as unconstitutional — even including repealing ObamaCare.
Obama’s Leftist coup d’état will then be complete.
At least, that’s their thinking.
I don’t believe this gambit will work. In fact, I think it could just as easily end up backfiring against Obama, Reid, and the Left.
Reid’s exercise of the “Nuclear Option” is being roundly criticized by the Washington Post and other mainstream liberal organs. Reid’s power-grab is too brazen even for them.
With the filibuster now effectively gone, this could easily work in favor of conservative constitutionalists. What’s good for the goose is good for the gander — tit for tat, and all that.
Harry Reid and Barack Obama have taught us that raw political power is all that matters now. The rights of the minority now count for nothing — zero, zip, nada.
A conservative President, for example, will be free to appoint Constitutionalists in the mold of Justices Scalia and Thomas by a single vote majority in the Senate, without concern their appointments could be Borked by a Dem filibuster.
If the five center-right Justices now on the court hang on for another three years (which now seems likely), a conservative President will be in a position to lock in a conservative majority on the Supreme Court for another generation or more.
A conservative revolution is clearly on the way in 2014 and very likely in 2016 as this disaster called ObamaCare plays out. 2014 and 2016 are shaping up to be 2006 and 2008 in reverse. Reid’s decision to end the filibuster will make it much easier and quicker to undo everything Obama has done to America.
So this is a high-stakes game Harry Reid is playing. He might succeed in cementing Obama’s Leftist Revolution as permanent through packing the courts. But Reid’s power-grab, I think, is more likely to backfire against Obama and the Left by making it much easier for Constitutionalists to erase Obama’s entire Presidency.
But then Reid recants after momentarily lurching into the truth.
